    3. Any deviations must be expressly agreed upon in writing.

    4. Where a provision conflicts with mandatory applicable law, the relevant statutory provision shall prevail.

    5. Mandatory consumer protection rights remain fully applicable.

Article 3 – Offers and Product Information

    1. Electrostart aims to provide accurate product descriptions, technical specifications, images, prices and availability information.

    2. Obvious errors or mistakes in offers shall not bind Electrostart to the extent permitted by law.

    5. Stock availability and estimated delivery times are provided as accurately as reasonably possible.

Article 4 – Formation of the Agreement

    1. An Agreement is established when the Customer places an order and Electrostart accepts it.

    2. The Customer will receive an electronic order confirmation.

    3. Electrostart may refuse an order for legitimate reasons, including suspected fraud or a demonstrable stock error.

    4. If an order cannot be fulfilled, the Customer will be informed as soon as reasonably possible.

    5. Payments for unavailable products will be refunded if no alternative arrangement is agreed upon.

Article 5 – Prices and Payments

    1. Prices are displayed in euros unless otherwise stated.

    2. Consumer prices include applicable VAT unless otherwise clearly indicated and legally permitted.

    3. Prices for Business Customers may be displayed excluding VAT where clearly stated.

    4. Shipping charges and any additional costs will be communicated before checkout is completed.

    5. Customers may pay using the payment methods offered during checkout.

    6. Electrostart reserves the right to modify available payment methods.

    7. In cases of late payment, applicable statutory rules concerning payment reminders, interest and collection costs shall apply.

Article 6 – Delivery and Shipping

    1. Electrostart aims to dispatch orders within the indicated delivery period.

    3. Unless otherwise agreed, Consumer orders will be delivered within 30 days, subject to applicable law.

    4. Customers will be informed of relevant delivery delays.

    5. Customers are responsible for providing accurate shipping information.

    6. For Consumers, the risk of loss or damage generally transfers upon physical receipt by the Consumer or their designated third party, subject to statutory exceptions.

    7. Separate delivery arrangements may apply to Business Customers where lawfully agreed.

Article 7 – Consumer Right of Withdrawal

    1. Consumers purchasing products online generally have the right to withdraw from the Agreement within 14 days after receiving the product, without giving a reason.

    2. For orders containing separately delivered products, the withdrawal period generally begins upon receipt of the final product.

    3. Consumers may exercise this right by clearly informing Electrostart within the statutory period, for example by email or through the withdrawal function provided on the website.

    4. Products must be returned within 14 days after notifying Electrostart of the withdrawal.

    5. Consumers may inspect products to establish their nature, characteristics and functionality.

    6. Consumers may be liable for diminished product value resulting from handling beyond what is necessary for such inspection.

    7. Direct return shipping costs may be charged to the Consumer, provided Electrostart has properly informed the Consumer before purchase.

    8. Electrostart will refund the amounts due, including standard original delivery costs, within 14 days after receiving the withdrawal notice.

    9. Electrostart may withhold reimbursement until the returned products have been received or the Consumer provides evidence of their return, whichever occurs first.

    10. Additional shipping costs resulting from choosing a delivery method more expensive than the least expensive standard option need not be refunded.

The right of withdrawal does not apply where a statutory exception is applicable and its legal requirements have been satisfied.

Business Customers do not automatically have the statutory consumer right of withdrawal.

    Article 8 – Business Returns

    1. Business Customers are not automatically entitled to the statutory consumer withdrawal period.

    2. Returns from Business Customers are accepted where Electrostart has agreed to them in advance or where required by law.

    4. Where Electrostart is legally responsible for a defective product, Consumers are entitled to applicable remedies, including free repair or replacement and, where legally appropriate, a price reduction or termination of the Agreement.

    5. Manufacturer warranties and additional commercial warranties do not restrict statutory consumer rights.
